Legal actions for compensation claims related to the truck price cartel are proceeding throughout Europe, including Italy, where on October 10, 2023, the Appeals Court issued a significant ruling on a compensation claim filed by several hauliers represented by lawyer Scoccini of the eponymous law firm. Several manufacturers (MAN, Iveco, Scania, Daimler, DAF, and Volvo/Renault) requested the court to acknowledge the statute of limitations against the compensation claim and argued that the European Commission's decision on the cartel should not be binding for national civil judgments.
The appellate judges rejected these requests. Regarding the statute of limitations, Scoccini's law firm commented on the ruling, stating, "the appellants' critique does not merit acceptance as it is evident that the term for the statute of limitations begins from the day the companies became aware of the damage and its injustice. Moreover, the appellants, who bore the burden of proof, did not demonstrate that such qualified knowledge dated back to at least 2011, thus before the European Commission's decision on July 19, 2016." The involved manufacturers have been ordered to reimburse legal fees amounting to approximately 100,000 euros.
